REGULAR MINUTES
May 8, 2002
PLANNING SESSION
The Board of Education met in the Administrative Conference Room at 12:15 p.m. for its Planning Session. In attendance were President Ronald W. Peppe, II; Deborah A. Aughenbaugh; Stephen Crawford; Anne B. Hooper; Linda S. Naylor; and Jean A. Smith. Vice President
Daryl A. Boffman was absent. Also in attendance were Jack D. Dale, Secretary-Treasurer, and Judith A. Ricketts, Administrative Director.
Mr. Peppe opened the meeting and noted scheduling issues including a change in the time of today’s Closed Session.
Mr. Peppe spoke regarding participation and issues raised at the Board of County Commissioners Public Hearing on the Board of Education’s budget.
Dr. Dale reviewed the issue of carryover and noted plans to address the budget with the Board of County Commissioners. Mr. Peppe discussed the Attorney General’s opinion on the FY ’01 surplus, and Dr. Dale addressed his plan regarding this surplus. He also discussed county revenue as well as FY ’03 BOE budget issues including costs for the charter school.
The meeting was recessed at 1:00 p.m. for a press conference on new state school construction funds, and the meeting was reconvened at 1:35 p.m.
Comments were made regarding allocation of state funds and unfunded projects.
The Handbook for Citizen Involvement was discussed. Mr. Peppe agreed to review the editing comments made by Mrs. Hooper and Dr. Crawford and submit the revised document to the Board for final review prior to distribution. It was noted that the National School Boards Association (NSBA) Code of Ethics needed Board of Education approval prior to inclusion in this document.
Mrs. Smith moved approval of the NSBA Code of Ethics. The motion was seconded by Dr. Crawford and unanimously approved.
As a Member of my local Board of Education, I will strive to improve public education, and to that end I will:
Attend all regularly scheduled board meetings insofar as possible, and become informed concerning the issues to be considered at those meetings;
Recognize that I should endeavor to make policy decisions only after full discussion at publicly held board meetings;
Render all decisions based on the available facts and my independent judgment, and refuse to surrender that judgment to individuals or special interest groups;
Encourage the free expression of opinion by all board members, and seek systematic communications between the board and students, staff, and all elements of the community;
Work with other board members to establish effective board policies and to delegate authority for the administration of the schools to the superintendent;
Communicate to other board members and the superintendent expressions of public reaction to board policies and school programs;
Inform myself about current educational issues by individual study and through participation in programs providing needed information, such as those sponsored by my state and national school boards associations;
Support the employment of those persons best qualified to serve as school staff, and insist on a regular and impartial evaluation of all staff;
Avoid being placed in a position of conflict of interest;
Take no private action that will compromise the board or administration, and respect the confidentiality of information that is privileged under applicable law; and
Remember always that my first
and greatest concern must be the educational welfare of the students attending
the public schools.
Board Notebook
The Board developed a table of contents for a Board notebook to serve as a reference manual for current members.
The Board was in agreement to allow Mr. Peppe to review and rewrite Board policy for consideration.
The Board agreed to place “student survey research center” on a planning agenda for discussion.
The Board was supportive of
including data as suggested by Mrs. Hooper in the Progress Report and on the
Board’s group web site.
Dr. Crawford provided rationale for his recommended revision to Goal 1, and discussion was held.
Dr. Crawford moved to adopt Goal 1 as follows:
All students will demonstrate the knowledge and skills necessary to graduate and to pursue their chosen career path.
The motion was seconded by Mrs. Smith.
Mrs. Aughenbaugh recommended that this language be reviewed by the Superintendent’s Cabinet prior to adoption. Mrs. Naylor supported the original language for Goal 1.
Following discussion, Mrs. Hooper recommended alternative language.
The motion failed to carry with Dr. Crawford, Mrs. Smith, and Mr. Peppe in support, and Mrs. Hooper, Mrs. Naylor and Mrs. Aughenbaugh opposed.
Mrs. Hooper moved to send the language suggested by Dr. Crawford to the Superintendent’s Cabinet for review along with the following alternative: replace to pursue their chosen career path with to be successful in life. Mrs. Naylor seconded the motion, and it was unanimously approved.
APPOINTMENTS TO THE MARYLAND ASSOCIATION OF BOARDS OF
EDUCATION LEGAL SERVICES ASSOCIATION
Mrs. Aughenbaugh moved to reappoint Jamie Cannon as the Board’s representative to the Legal Services Association (LSA). The motion was seconded by Mrs. Smith and unanimously approved.
Mrs. Smith moved to appoint Paula Lawton as the alternate representative to LSA. The motion was seconded by Mrs. Aughenbaugh and unanimously approved.
In accordance with Maryland’s Open Meetings Act, Section 10-508(a)(1)(i), (1)(1)(ii), (a)(8), and (a)(9), Dr. Crawford moved to go into Closed Session to discuss Personnel, Negotiations, and Potential Litigation. The motion was unanimously approved
No formal action was taken.
The minutes of the April 17, 2002, Closed
Session were unanimously approved.
The Board consensually approved a position for potential settlement.
Members of the Insurance Council joined the Board. No formal action was taken.

meeting was adjourned at 6:05 p.m.

MEETING
The Board of Education of Frederick County met for its regular meeting
in the Board Room at 6:15 p.m. All
Board of Education members were present except Vice President
Daryl A. Boffman. Ryan C. Tuck, Student Representative to the
Board, and John L.
Thompson, Jr., County
Commissioner Liaison to the Board of Education, were absent.
Mr. Peppe called the meeting to order, and the Pledge of Allegiance was
recited.

The agenda was unanimously approved.
PUBLIC COMMENTS ON TRANSFER OF STUDENTS
FROM THOMAS JOHNSON MIDDLE SCHOOL TO OAKDALE MIDDLE SCHOOL
Comments by
Anita Waravdekar
Ms. Waravdekar requested that the students in Oak Acres
attend Oakdale Middle School beginning in 2004, and that her son who will be in
eighth grade at that time be grandfathered and remain at Gov. Thomas Johnson
Middle School for his last year.
Comments by
Bonnie Borsa
Mrs. Borsa supported Ms. Waravdekar’s comments stating that in 2004
there will be six children from her community that would like to be
grandfathered at Gov. Thomas Johnson Middle School for their final year. She noted that there are 23 families from
Oak Acres that have children from birth to fifth grade.

Patty Sheehan
Mrs. Sheehan noted how things have changed since she
originally canvassed the Oak Acres neighborhood three years ago when the
families were in support of keeping their children at Gov. Thomas Johnson
Middle School. She stated that she
strongly supports the petition to move the Oak Acres students to Oakdale Middle
School in 2004.
CLOSED SESSION ANNOUNCEMENT
In accordance with Maryland’s Open Meetings, Mr. Peppe announced the
time and place of the Closed Session, cited the section of the law for closing
the meeting, and noted the topics discussed.
APPROVAL OF MINUTES
The Board unanimously approved the minutes of the April 16, 2002,
Special Meeting, and unanimously approved Regular Minutes of April 17, 2002, as
amended by

Dr. Dale indicated that he will rewrite the policy and
regulations to change the process with no Citizens’ Advisory Committee, but
with a series of community meetings to allow everyone to participate, after
staff generates several options. Staff
would explore methods for increasing public communication and feedback.
SALUTE TO FOOD AND NUTRITION SERVICE
PERSONNEL PROCLAMATION
Cheri Dattoli, Food Service Officer, spoke regarding the
School Food and Nutrition Program and recognized Sandy Shankle, Middletown
Complex Manager, Susie Whitter, Brunswick Complex Manager, Cassandra Allison,
Brunswick Site Assistant, and students of Brunswick Elementary School who were
featured in the video on school food and food service personnel which was
presented. Brunswick Elementary School
received first place awards in the Breakfast Quest contest at both the local
and state levels. The following proclamation was presented:
WHEREAS, The
Food Service employees are dedicated to the health and well-being of children;
and
WHEREAS, The
Food Service employees serve over 2.5 million nutritious meals to Frederick
County Public School students annually; and
WHEREAS, The
Food Service employees provide many services to students, faculty, parents and
other customers and are an important part of the educational process; and
WHEREAS,
There is a continued need for support and awareness of the valuable
contributions that the Food Service employees make to the Frederick County
Public School System; now, therefore, be it
RESOLVED, That
we, the members of the Board of Education of Frederick County, believe it
appropriate to recognize the Food Service employees and the important work they
perform; and be it
RESOLVED, That
the members of the Board of Education do hereby encourage the observance of
Salute to School Food and Nutrition Service Personnel Day throughout the
Frederick County Public School System and commend this observance to all
citizens.
Upon motion by Mrs. Smith, seconded by Dr. Crawford, the
Board unanimously adopted the proclamation.

Architects, Inc. appointed as the architectural firm to perform the design of
the Urbana Area Elementary School based on the Deer Crossing Elementary School
prototype at a base design fee of $437,573 including a printing cost and fire
flow test reimbursable allowance of $8,350 and as a possible add to the base
design fee, a building commissioning fee of $12,608.
NAMING OF SOUTH FREDERICK CITY AREA ELEMENTARY SCHOOL
John George, Curriculum
Specialist for Social Studies, K-5, and Chair of the Naming Committee for the
South Frederick City Area Elementary School, recognized the individuals who
served on this committee and recommended the name of Tuscarora Elementary
School for the name of the new school being constructed in the Wellington Trace
subdivision on the east side of Ballenger Creek Road.
The Board unanimously
approved the recommendation.
TRANSFER OF STUDENTS
Ray Barnes, Executive
Director of Facilities Services, noted that at the April 17, 2002, Board of
Education meeting, the Board decided to give consideration to one of the
petitions affecting the geographic area known as Oak Acres, the area between
Meadow Road and Quinn Road north of Route 144.
He noted that staff has clarified the area under consideration to
include all houses along Quinn Road, both north and south of I70. He noted that staff sent an announcement to
all of the parents who may be affected by this decision notifying them of the
process to submit written comments or present public comments at today's
meeting. Mr. Barnes recommended the
option for incoming eighth grade students to remain in their home school in 2004.
Mr. Peppe noted that
all of the emails sent to the Board were in support of the recommendation to
allow the students living in this geographic area to attend Oakdale Middle
School.
Mrs. Hooper moved to
approve the recommendation to be effective in 2004 for the area defined by Mr.
Barnes with the option for eighth grade students to stay in their home
school. The motion was seconded by Mrs.
Aughenbaugh and unanimously approved.
PERSONNEL APPOINTMENTS
Michele Krantz,
Associate Superintendent, recommended the appointment of Pam Pencola to the
position of Principal at Carroll Manor Elementary School.
Upon motion by Mrs.
Hooper, seconded by Dr. Crawford, the Board unanimously approved the
appointment.
BOARD MEETING CALENDAR
The Board unanimously
approved the Board of Education meeting calendar for 2002-2003 (attached).
MARYLAND ASSOCIATION OF BOARDS OF EDUCATION PRESENTATION
Dr. Carl Smith,
Executive Director of the Maryland Association of Boards of Education (MABE),
along with Rodney Durst, President of the MABE, provided background information
on the association. Mr. John Woolums,
Director of Governmental Relations for MABE, discussed the legislative process
and labor issues and shared MABE’s vision on governmental relations. Mr. Woolums responded to Board members’
questions.
COMMENTS
Dr. Dale noted that the
Governor announced his funding for the state school construction program, and
that Frederick County will be receiving an additional $4 million for
construction of Crestwood Middle School to open in 2004, and planning approval
for Middletown Elementary School. He
recognized the County Commissioners for forward funding projects to allow us to
continue with construction projects in a timely manner.
Mr. Peppe reported on
the Board of County Commissioners’ Public Hearing on the Board of Education’s
Budget.
Dr. Dale noted that he
has received letters regarding the sewer situation at Linganore High.
Mrs. Naylor thanked
all who have served on various Board committees. She pointed out that the Family Life Advisory Committee reviewed
the Family Life videos on today’s agenda.
